With the recent high-profile celebrity deaths like Michael Jackson and Farah Fawcett, the issue of how a will can provide for your wishes after death has become front and center. According to Antelope Valley estate planning attorney Kevin Von Tungeln, no one, regardless of the size of their estate should be without a will.
A will is a basic level of protection that assures that your wishes for the disposition of your estate will be followed. A will can also determine who will have custody of any minor
children and direct assets to their ongoing care. No one should die without a will. At a minimum it makes your wishes clear to your family and reduces the potential for conflict after
your death.
There are several estate planning tools available to estate planning attorneys, and a will is the simplest tool. However, this tool is not right for everyone. Depending on your family and
financial situation, other tools such as trusts may be more advisable. A certified estate planning specialist can guide you to the right mix of legal instruments to protect your assets,
protect your children, and make any charitable bequests that you want after your death.
Many people die believing that their verbal instructions will be carried out, said Von Tungeln. But many times those instructions are not carried out because of family quarrels and other
issues that emerge after one passes away. A will is a binding way of ensuring that your wishes will be heard and carried out. I encourage everyone to make sure they have this basic level
of protection, especially if they have children.
