Truck driver Carlos Aguilar backed his trailer into a Gallery Furniture loading bay hitting and injuring plaintiff Charles Lemmond. An aggressive defense by John Ramirez revealed Lemmond'ss lack of compliance with workplace safety rules and training procedures. The jury found Lemmond violated best safety practices and put no fault on Texan Eagle and Aguilar.
