The Haryana Industrial Promotion Act, 2005 has come into force to provide for simplification of Regulatory Framework for SpeedyImplementation of Industrial and other projects in the State by providing single point time bound clearances required for setting up of industrial undertakings and assist promoters, reduce procedural requirements and rationalise documents.

Chandigarh February 16, 2006 -- The Haryana Industrial Promotion Act, 2005 has come into force to provide for simplification of Regulatory Framework for SpeedyImplementation of Industrial and other projects in the State by providing single point time bound clearances required for setting up of industrial undertakings and assist promoters, reduce procedural requirements and rationalise documents.

While stating this here today, a spokesman of the industries department said that the Act would also ensure hassle free operation for the promotion of industrial development and facilitation of new investments and provide for an investor friendly climate in the State. The spokesman said that the Act provided for constituting a High Powered Clearance Committee to receive composite application forms for grant of clearances to set up industrial units with proposed investment of Rs. 30 crore and above. It would reviewand monitor the processing of applications by the authority and forward the orders of the authority tothe applicant. The committee would inform the entrepreneur, the date on which his application would be deemed to have been approved in the case of deemed approval.

Also, the committee would be the final authority in granting clearances and the clearance sgiven by the committee would be binding on all concerned authorities. The authorities would issue the required clearances to the entrepreneurs within the stipulated period. He said that the Act also provided for a single point clearance committee known as state level clearance committee. It would receive composit application forms for grant of clearances for setting up of industrial units with propose investment of above Rs. five croresand below Rs. 30 crores.

It would also review and monitor the processing of application by the authority and forward orders of the authority to the applicant. It would inform the entrepreneurs the date on which such applications would be deemed to have been approved in case of deemed approval. This committee would be the final authority in granting final approval. Similarly, district level clearance committees would be constituted to receive composit application forms for grant of clearances for settingup of industrial units with proposed investment uptoRs. five crores. He said that any person aggrieved by the decision ofthe high powered clearance committee or state level clearance committee and district level clearance committee disapproving the project, might within 30days from the date of receipt of recommendation of the decision of the committee, appeal to the concerned appellate authority. The appelate authority would dispose off the appeal within one month from the date of its receipt.

He said that the Act also provided for appointing investment promotion centre at Chandigarh as a nodal agency at the state level and district industries centre as the district nodal agency at the district level. The nodal agency aims at guiding and assisting entrepreneurs to set up industries in the state.
