Case Filed Against ADP Claims California Code Writers are Eligible for Overtime
California Labor Code 515.5 applies to computer programmers and code writers who were not paid at least $99,445 per year in 2006.
It now seems like Automatic Data Processing, Inc. is in violation of this law, and may be required to pay their computer code writers and programmers, overtime, interest and penalties going back as much as 4 years.
Federal labor laws require overtime pay for eligible employees who work more than 40 hours a week, but in California overtime pay must be calculated on a daily basis 's8211; requiring companies to pay for overtime after an eligible employee has worked more than 8 hours in any single day.
Computer programmers and code writers who are working, or have worked, for ADP, are alleging the company is trying to avoid paying legitimate overtime claims by not correctly calculating employees's8217; overtime hours, based on California labor laws.
Case No. RG06268889, Reynov v. ADP, has been filed in Alameda Superior Court.
