Attorney Todd Berkey, a partner with Edgar Snyder & Associates, has filed a civil complaint against Hospitality Group Services, Inc., (filed in the Court of Common Pleas of Westmoreland County, Pa., No. 5997 of 2007) which owns and operates the Ramada of Historic Ligonier where Sean worked as a dishwasher. Sean had finished a 16-hour workshift at the Ramada, clocking out at 3:06 am. He also had access to alcoholic beverages in the bar, kitchen and other areas of the hotel and was working unsupervised from approximately 1:00 -3:00 am. At the time of Sean's death, his blood alcohol level was 0.14.
The complaint filed by Attorney Todd Berkey, on behalf of the teenager's mother, Terri Nemcheck, alleges among other things that the Ramada Inn violated Pennsylvania child labor and Liquor Control Board laws.
"We believe that Sean's fatal crash was due to a combination of his fatigue from having worked a 16-hour shift and his intoxication from consuming alcohol at the Ramada Inn while he was under their employ," said Attorney Berkey of Edgar Snyder & Associates.
