Attorney Commences Efforts to Put an End to Confidentiality Clauses in Medical Malpractice Cases
Following on the heels of several landmark cases in his practice, Attorney Cory Rosenbaum, is establishing End Confidentiality, a group devoted to ending doctors and hospitals practice of hiding negligence and malpractice cases behind confidentiality agreements.
To establish the group s efforts, Cory Rosenbaum has created a preliminary website at http://www.webdedication.com/endconfidentiality to act as a clearinghouse for information. The website will contain press releases, case studies, articles and a forum to connect people with the information they need to push legislation to prohibit confidentiality agreements in medical malpractice cases.
As it is right now, many medical malpractice suits end up hidden behind confidentiality agreements. This prevents anyone from talking or writing about what happened. It helps bad doctors and hospitals hide their negligence from future patients. It has to stop. The public has a right to know, said Mr. Rosenbaum.
In a recent case handled by Cory Rosenbaum s firm, the Supreme Court of New York for Rockland County refused three pediatricians request to force Mr. Rosenbaum to remove their names and references to the lawsuit against them from his website. The pediatricians were sued for causing the prolonged death of Christopher Rivas, a six-month old baby.
Cory Rosenbaum, the attorney for the deceased baby and the parents, believes that, It is wrong to bury the facts when a doctor hurts a baby or any patient. Parents, and all of us, need to be able to find out about bad doctors.
The Court was made aware that the six-month old died as a result of a common infection (swimmer s ear); that the baby had been seen by the doctors ten times over six-weeks; and, in all that time, the doctors never ordered blood tests, x-rays, or even diagnosed the illness.
The Rivas family had to bury their son, and now these doctors wanted the Court to help them bury the information about what they did, said Mr. Rosenbaum.
