laiming that on July 17, 2004, brothers Philip and Christopher Faiella were allegedly severally beaten and falsely arrested by Hartford Police Department police officers at a Dave Matthews concert at the former Meadow's8217;s Music Theater in Hartford.
Hartford, CT August 2, 2006 -- We depend on the police to protect us from danger and keep us safe. But what happens when two brothers attending a concert allegedly need protection from
the police assigned to keep them safe Attorney Paul Spinella of Spinella & Associates believes that police misconduct is a prevalent problem in Hartford that continues unabated.
In an effort to preserve our constitutional rights and protect us from future incidents of police abuse, Spinella has taken on the case of two brothers allegedly fiercely beaten by
Hartford police officers at a Dave Mathews concert during the summer of 2004.
The lawsuit, Philip M. Faiella, Jr., et al v. The city of Hartford, et al, (civil action number: 3:06 cv 01050) filed in the United States District Court in Hartford on July 6, 2006,
claims that on July 17, 2004, brothers Philip and Christopher Faiella were allegedly severally beaten and falsely arrested by Hartford Police Department police officers at a Dave Matthews
concert at the former Meadow's8217;s Music Theater in Hartford, Connecticut.
The lawsuit claims that the two brothers were leaving the Theater when Hartford Police Officers began firing rubber bullets and tear gas canister into a crowd that gathered in the parking
lot. While seeking cover behind parked cars, Hartford Police Officers located the two brothers and allegedly beat them without cause or provocation. The suit claims Phillip Faiella was
rendered unconscious by the pummeling he received at the hands of the police officers, while his brother Christopher was handcuffed and beaten. One officer spit in Christopher's8217;s
face and taunted the brothers with ethnic slurs, according to the claim.
The two brothers, both college students in their early twenties at the time of the incident, suffered well-documented physical injuries, Spinella said. Further, this alleged unprovoked
attack has caused serious emotional and mental damage to the two young men.
The lawsuit also claims that the policies and customs of the City of Hartford and the Hartford Police Department led to the unlawful behavior of its police officers.
In order to defend and uphold the constitutional rights of all citizens, and deter such future abuses, the Faiella brothers have taken the police officers that allegedly attacked them to
court and challenged the policies of the Hartford Police Department and City of Hartford, CT that allegedly foster such unlawful conduct.
Spinella and Associates believe that Though taking our police force to court helps defend victims's8217; rights, it is public outcry from ordinary citizens that police brutality will not
be tolerated that will gain the attention of the state and city authorities necessary to bring about permanent change.
