As the UK turns its mind to the thought of booking 2009 holidays, Wolferstans (www.wolferstans.com), the Plymouth based law firm, is looking to draw peoples's8217; attention to the potential hazards if anything goes wrong.
Tim Roper, Head of Personal Injury at Wolferstans (www.wolferstans.com) comments: 's8220;People should be aware of how they are covered in case of
an accident, especially if booking a package deal. Booking excursions or ski instruction as part of the package, when you book your holiday with a UK Company means you will be eligible to
claim damages in the UK, subject to contractual provisions, in the case of a fault based accident. If you wait until you arrive at your destination to book these things you may be forced
to sue in the country where the accident took place, which may be far more difficult.'s8221;
This was recently highlighted with the case of Plymouth businessman Graham Anderson who was tragically paralysed in a skiing accident in 2004, and whom Wolferstans successfully
represented in a liability trial earlier this month. Wolferstans will now be quantifying the damages which will include loss of earnings, damages for past and future costs of care and
equipment, accommodation and therapy.
Andrew Warlow, in charge of the Head and Spinal Injuries Unit at Wolferstans, who represented Mr Anderson adds 's8220;As a general principle you have more protection if you book in the UK
add-ons to your holiday at the same time as, and with the same UK company as, you booked your holiday. In the event of an accident you really do not want to be tied into another
Country's8217;s legal system, it is likely to take longer to settle; be more complicated and is unlikely to be as satisfactory.'s8221;
Wolferstans (www.wolferstans.com) also stress the importance of adequate insurance cover. A dangerous and incorrect assumption for a holidaymaker
is to believe they need not take out their own insurance, since they will be covered by the insurance of the holiday firm they book with. Suitable insurance cover, including, if it can be
obtained, cover that provides substantial funds if permanent serious injury should occur is always a wise move, as well as to ensure the insurance covers any particular activity to be
undertaken.
