Zone Medical LLCs Claims Against IFlow Corporation Over LatexExposure...

San Diego, CA May 6, 2009 -- Zone Medical, LLC, the worldwide distributor for the Solace's174; Post Operative Pain Relief System, reports that on April 13, 2009 the Honorable Dana M. Sabraw, United States District Judge in the Southern District of California, denied I-Flow Corporation'ss motion for summary judgment regarding Zone'ss counterclaims for unfair competition under the Lanham Act, unfair competition under the California Business and Professions Code section 17200 and common law unfair competition.



According to the case (Case No. 07-cv-1200), Zone alleges that I-Flow makes false representations about latex exposure risks from the ON-Q pain pump in a Technical Bulletin entitled Latex Sensitivity that I-Flow distributes through its representatives and its website. Zone also claims that I-Flow makes false representations regarding latex exposure risks in package inserts distributed with I-Flow'ss ON-Q pain pump. It is important that latex exposure risks are fully disclosed to the public, including patients and healthcare professionals. Zone believes that I-Flow misrepresents latex exposure in I-Flow'ss ON-Q pain pump to gain commercial advantages and to the detriment of patients and healthcare professionals, as well as I-Flow'ss competitors.



Zone maintains in its case that the cover of I-Flow'ss ON-Q pain pump contains holes and as latex is right underneath that cover, the holes allow latex contact by patients and healthcare professionals (and anyone handling an ON-Q pump of I-Flow). Zone believes that patients and healthcare professionals should be informed of all risks of latex exposure from I-Flow'ss ON-Q pain pump so they can make informed choices. Moreover, if a patient or healthcare professional suffers a latex reaction to I-Flow'ss ON-Q pain pump and they have not been made aware of the risks of latex exposure, they may not recognize it as such and may thereby fail to receive proper treatment.
