USA Next Urges Millions of Activists to Stop the Filibuster of Judicial Nominees



May 18, 2005 -- USA Next Chief Executive Charlie Jarvis has launched an aggressive online communication campaign to urge millions of Americans to contact their Senators and encourage them to defend the Constitution by bringing an end to the filibuster of judicial nominees.

Excerpts from the email follow:
"The battle over the filibustering of judges is not merely a "political" battle. It is actually a battle over the US Constitution and this is not a battle Americans can afford to lose."

"By arrogantly demanding a 'super majority' vote on federal judges, Senators are not merely prolonging debate or "denying the President his due.' "They are purposely refusing to uphold or preserve or protect the Constitution. That puts them in violation of their oath of office, an extraordinarily serious offense worthy of being treated that way.

"The Framers of the US Constitution were absolutely specific about what actions under the Constitution would require a "super majority" vote," Jarvis adds. "Those situations are rare and carefully laid out. Senate confirmation of federal judges is definitively NOT one of those situations. Any attempt to create a standard not specified in the Constitution, without amending the Constitution, is nothing short of a violation of the Constitution."

"Over the last century, we have been suffering an incremental second American revolution, in many ways reversing and undermining the first. Federal judges and many in Congress have often treated the actual text of the US Constitution as if it is an interesting, somewhat useful, quaint but outdated document created too long ago to suit our 'sophisticated and complex era.'

"Americans who revere the Constitution need to rise up and boldly say, 'The Constitution is what the Constitution says, not what politicians, judges, and unelected bureaucrats want it to say!' To Senators violating their oath of office, we must say, 'Enough is enough!' These Senators must be held publicly accountable.

USA Next is launching an aggressive online communication campaign to take this critical message to millions of Americans. It will be one of the most aggressive Internet campaigns ever launched to put an end once and for all to the political games being played in the Senate when it comes to President Bush's judicial nominations.

"Senators Reid, Clinton and others are trying to replace the Constitution's authority with Senate rules," said Jarvis. "It's time that millions of Americans stand up and tell them: It's the Constitution, Senator!"
