Skincare Company Dismissed Without Prejudice from Patent Infringement Lawsuit Filed by Allergan Inc.



DermaQuest Skin Therapy, one of the 7 companies sued by Allergan, Inc. in a patent infringement case no. SACV07-1316 JVS over a prostaglandin-based ingredient, was dismissed from the suit by certified letter from Allergan on December 6, 2007. The lash conditioning product sold by DermaQuest Skin Therapy named DermaLash, is sold to the professional skincare market, and was found after inspection by Allergan not to contain any ingredients or drugs infringing on their patent of Lumigan.

"Upon notification of the lawsuit by Allergan, DermaQuest and I informed the public that our lash-conditioning product never had drugs or patent infringing ingredients in its formulation," said Sam Dhatt, owner of DermaQuest Skin Therapy. "I promptly submitted the complete ingredient list and all necessary paperwork to Allergan, Inc. to prove our innocence in this case and asked for prompt dismissal."

DermaLash was released in the skincare market mid-2007 as a drug-free alternative to some of the other lash conditioning products on the market. DermaQuest Skin Therapy's DermaLash contains ingredients from naturally-derived sources to strengthen and condition the lashes such as copper, biotin and amino acids. "I am pleased to have the case dropped against DermaQuest Skin Therapy so we can move forward with our business," says Dhatt. "We definitely do not want the negative press or to suffer financial loss from a case like this."
