Agency Software, Inc., a popular U.S. insurance software company, today announced that it successfully settled its trademark infringement lawsuit against Word 's38; Brown Insurance Administrators. Under the terms of the settlement, Word 's38; Brown will cease using the AgencyPro trademark for any of its products or services, promptly cancel its trademark registration in the AgencyPro mark with the U.S. Patent 's38; Trademark Office, and provide Agency Software with monetary compensation.
This settlement was the result of a trademark infringement lawsuit between Agency Software and Word 's38; Brown in the U.S. District Court for the Central District of California. Agency
Software sought damages and injunctive relief contending, among other things, that Word 's38; Brown'ss use of the AgencyPro trademark within the insurance industry infringed upon Agency
Software'ss long-standing AgencyPro trademark. (Word 's38; Brown Insurance Administrators, Inc v. Agency Software, Inc. U.S. District Court, Central District, Case No. 8:08-cv-00423).
This case was centered on our necessary efforts to protect our AgencyPro trademark against consumer confusion within the insurance industry, said Mitch McInelly, corporate president for
